Cancellation terms, including any deposits that may be retained or refunded, are specified in the written contract for each project. In general, any work already performed or materials already ordered at the time of cancellation may be billed.
We reserve the right to reschedule or suspend work due to unsafe weather conditions, including during Florida's hurricane season (June through November), without penalty to either party.
Payment terms are set out in the written contract for each project. Typical payment schedules include a deposit at contract signing, progress payments at defined project milestones, and a final payment upon project completion and your acceptance of the work.
All invoices are due and payable as specified in the contract. Overdue amounts may be subject to late fees at the rate stated in the contract or, if not stated, at the maximum rate permitted under Florida law.
We accept payment by check, bank transfer, or other methods specified in the contract. Full payment is required before any warranty claims will be processed.
Where required by Brevard County or applicable Florida law, West Melbourne Fence & Deckwill obtain the necessary building permits for your project. Permit fees are included in or separately itemized in the project contract.
You are responsible for obtaining any required approval from your homeowners association (HOA) before work begins. We are not liable for any HOA-related disputes, fines, or required modifications arising from a failure to obtain HOA approval prior to the start of work.
Any workmanship warranty provided by West Melbourne Fence & Deck is limited to the terms stated in the written contract for your specific project. Material warranties, where applicable, are provided by the manufacturer of the materials and are subject to the manufacturer's terms and conditions.
Warranties do not cover damage caused by natural events (including hurricanes, flooding, or other acts of nature), improper use, lack of maintenance, modifications made by third parties after project completion, or normal wear and tear.
Except as expressly stated in a written contract, West Melbourne Fence & Deck makes no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, West Melbourne Fence & Deck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a project shall not exceed the total amount paid by you for that specific project.
If a dispute arises between you and West Melbourne Fence & Deck related to our services or these Terms, we encourage you to contact us first so we can attempt to resolve it directly. Most issues can be resolved quickly through direct communication.
If a dispute cannot be resolved informally, it shall be submitted to binding arbitration under the rules of the American Arbitration Association, with the arbitration taking place in Brevard County, Florida. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
